General Terms of Sale

Overview

These General Terms of Sale (GTS) govern all services provided by VulcainDesign (Sébastien Conde Patron, sole trader, SIRET: 988011409), including website creation, web application development, and communication materials (logos, brand guidelines, flyers, business cards, etc.).

Unless otherwise specified in the quotation or contract, all services are set up and hosted on VulcainDesign servers and made available to the client.

Quotations and Orders

Every service begins with a written quotation accepted by the client. An order is confirmed upon receipt of the signed quotation and, unless otherwise stated, a 30% or 50% deposit.

Timelines

Delivery times are estimated in working days and begin upon receipt of all required materials. Delays caused by the client (late approvals, content delivery, etc.) will suspend the agreed timeline.

Pricing and Payment

All prices are quoted in euros including tax (VAT not applicable — Article 293B of the French Tax Code). The balance is due upon project delivery. Payment is made by bank transfer.

Late Payment

Any late payment will incur penalties of 10%, plus a flat-rate recovery fee of €40 (pursuant to Article L441-6 of the French Commercial Code).

Intellectual Property

All deliverables (website, design, logos, etc.) remain the property of VulcainDesign until full payment is received. Upon receipt of full payment, usage and exploitation rights are transferred to the client, unless otherwise agreed.

Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to personalised or custom-made services.

Liability

VulcainDesign is committed to delivering professional-quality work but cannot be held responsible for technical issues arising from the hosting provider, third-party services, or improper use of deliverables by the client.

Disputes

In the event of a dispute, an amicable resolution will be sought first. Failing that, the competent court will be that of the jurisdiction where VulcainDesign has its registered office.
